The terms SOFTWARE and SOFTWARE PRODUCT refers to all
software products that TPA Software sells. For a
complete product list of SOFTWARE PRODUCTS that this
License Agreement covers, please view the Products
page.
AMERICA ONLINE INC AOL
DID NOT WRITE, AND SHALL NOT WARRANT, SUPPORT, OR ENDORSE
THIS SOFTWARE. THE RECIPIENT / USER OF SUCH MATERIAL DOES
SO AT THEIR OWN RISK. AMERICA ONLINE INC. ACCEPTS NO
RESPONSIBILITY OR LIABILITY WHATSOEVER.
The
SOFTWARE PRODUCT is protected by copyright laws and
international copyright treaties, as well as other
intellectual property laws and treaties. The SOFTWARE
PRODUCT is licensed, not sold.
GRANT OF LICENSE
This License Agreement grants you the following rights:
DISCLAIMER:
The SOFTWARE PRODUCT is distributed and licensed on an
"as is" basis and no warranties or guarantees of
any kind are promised by TPA Software as to its
performance, reliability or suitability to any given task.
In no event shall TPA Software be liable for any loss of
data or ANY DAMAGES OF ANY KIND, financial, physical,
emotional or other, which might arise from its use.
Either the author, nor his
representatives, agents, partners or other related parties
shall be held liable for damages of any type, financial or
otherwise.
DISTRIBUTION:
The SOFTWARE PRODUCT may NOT be sold without prior written
consent from TPA Software.
REGISTRATION:
You may register the SOFTWARE PRODUCT with either your
credit card, a money order, a check or cash. There may be
a 24-48 wait for all credit card transactions. There
is a 10-15 day wait on all personal checks. If you
register the SOFTWARE PRODUCT with a personal check, a
registration number will not be issued until the personal
check has cleared the bank. All registrations with money
orders and cash are sent the same day they are received.
RETURN CHECK/CHARGEBACK
POLICY:
All returned checks are subject to a fee of $30.00 plus
the original amount of the check. All chargebacks from
credit card companies over disputed charges for the
registration fee of our products are subject to a $50.00
fee plus the cost of the original charge. All returned
checks/chargebacks may also be turned over to collection
agencies for reconciliation. TPA Software reserves the
right to charge $1.00 each month in late fees for a
returned check is not reconciled. In the event that
returned checks and chargeback debts are not reconciled in
a timely manner, TPA Software can and will suspend
registration numbers and technical support until such time
as bad debts are reconciled.
ACCOUNTS AND REGISTRATION
NUMBERS FOR AOL ADD ONS:
Registrations numbers are non-transferable between AOL
accounts and other programs offered by TPA Software.

REFUNDS:
All sales of our products are final. No refunds
will be issued, guaranteed or promised. Please be aware
that once a registration number has been issued, there is
no way for TPA Software to recall or rescind a
registration number. There is no way for TPA Software to
be guaranteed that WavMan has been uninstalled and is no
longer being used.
The whole concept of
shareware is that the program may be evaluated FREE
for an extended period of time. This is to ensure that the
program is working to satisfaction BEFORE payment
is submitted for the program.
LIMITATIONS ON REVERSE
ENGINEERING, DECOMPILATION AND DISASSEMBLY:
You may not reverse engineer, decompile or disassemble the
SOFTWARE PRODUCT, except and only to the extent that such
activity is expressly permitted by applicable law
notwithstanding this limitation.
TERMINATION
Without prejudice and other rights, TPA Software may
terminate this License Agreement if you fail to comply
with the terms and conditions of the License Agreement. In
such an event, you must uninstall and destroy all copies
of the SOFTWARE PRODUCT.
MODIFICATION
TPA Software reserves the right to change this License
Agreement at anytime without warning.
COPYRIGHT
All title and copyrights in and to the SOFTWARE PRODUCT
are owned by TPA Software. The SOFTWARE PRODUCT is
protected by copyright laws and international treaty
provisions.
